In short: PhotoGen uses AI to place your photo into event artwork. By using it, you let Memik, its subsidiaries (including Photopic) and our event partners use the pictures you create for social media and marketing.

1. Who we are

PhotoGen is operated by Memik and its subsidiaries, including Photopic ("Memik", "we", "us"). PhotoGen is offered with the organizations and partners we run events with ("Event Partners"). These Terms apply whenever you use PhotoGen at photopicselfie.com/photogen.

2. Who can use PhotoGen

You must be at least 18 years old, or have permission from a parent or legal guardian who agrees to these Terms on your behalf. You must provide accurate information in the contact form.

3. Your photos

Only upload or take photos of yourself, or of people who have agreed to be photographed and to these Terms.
Don't upload photos that are illegal, hateful, sexually explicit, violent, or that infringe anyone else's rights.
You keep whatever rights you have in the photo you take or upload.

4. How your pictures may be used

When you create a picture with PhotoGen, you give Memik, its subsidiaries and affiliates, and our Event Partners a non-exclusive, worldwide, royalty-free, perpetual and irrevocable license to use, reproduce, display, publish, distribute, crop and adapt:

the pictures PhotoGen generates for you, which include your likeness, and
the photo you submitted to create them,

for social media, marketing, advertising and promotional purposes, in any media, without payment or further notice to you. We won't use your email address or phone number in anything we publish.

5. AI-generated pictures

Pictures are created by an artificial intelligence image model. Results can be imperfect or not look exactly like you. Pictures are provided for personal, non-commercial use by you; please don't present them as unaltered photographs.

6. Acceptable use

Don't misuse PhotoGen: no automated or excessive requests, no attempts to break or get around its limits or security, and no use that violates the law or others' rights. We may block access to anyone who does.

7. Disclaimers

PhotoGen is provided "as is" and "as available", without warranties of any kind. To the fullest extent allowed by law, Memik and our Event Partners are not liable for indirect, incidental or consequential damages arising from your use of PhotoGen.

8. Changes

We may update these Terms. If we make material changes, PhotoGen will ask you to review and accept them again before your next picture.
